These Terms and Conditions for DJI Unlock Feature apply to your use of the unlock feature (the "Unlock Feature") provided by SZ DJI Technology Co., Ltd. and its affiliates ("DJI", "we," or "us"). Please read these Terms carefully. By accessing, applying for, or using the Unlock Feature in any manner, you acknowledge that you have read and understood these Terms and Conditions for DJI Unlock Feature, the DJI Privacy Policy, and the DJI Website Terms of Use (together, these "Terms") and agree to be bound by them.
If you agree to these Terms or access and/or use the Unlock Feature on behalf of an entity, organization, company, or individual other than yourself, you represent and warrant that you have the authority to bind such entity, organization, company, or individual to these Terms, and you agree to be bound by these Terms on behalf of such party. If you are not eligible or do not agree to these Terms, then you may not apply for or use the Unlock Feature.
Please read the information disclosed below carefully, as we have established specific information practices and disclaimers for the Unlock Feature that may differ from the rest of the Terms. In the event of any conflict between the terms and conditions below and any other agreements you have entered into with DJI regarding the issues stipulated herein, the following terms and conditions shall prevail.
The Unlock Feature is designed to assist you, during your use of DJI products or services, in applying to remove certain zone or feature restrictions that have been set due to safety, security, or regulatory factors. Given the high sensitivity and risk associated with such restricted zones or features, we may require you to provide supporting materials related to your unlocking application (including but not limited to qualifications or approval documents used to verify whether you are authorized to fly in the designated area).
To apply for the Unlock Feature, you may be required to provide us with some information about yourself, authorised entity, and your flight plan.
You represent and warrant that the information you provide to us is true, accurate, complete, and valid, and you undertake to update such information promptly when it changes.
You shall bear full legal responsibility for all activities that occur under your DJI account, as well as for all flight and operational conduct within unlocked zones or otherwise in connection with the Unlock Feature using the relevant hardware devices.
We use and disclose the information you provide to us in accordance with the DJI Privacy Policy.
YOU ARE SOLELY RESPONSIBLE FOR THE SAFETY OF YOUR FLIGHT OPERATION. DURING YOUR USE OF DJI PRODUCTS AND/OR SERVICES (EVEN IF USED IN NON-RESTRICTED ZONES OR UNLOCKED RESTRICTED ZONES), YOU REMAIN SOLELY RESPONSIBLE FOR OBTAINING ALL NECESSARY AUTHORIZATIONS FROM RELEVANT GOVERNMENTAL OR REGULATORY AUTHORITIES, MAINTAINING A SAFE DISTANCE FROM MANNED AND UNMANNED AIRCRAFT, STRUCTURES, VEHICLES, GROUND HAZARDS, INFRASTRUCTURE, EMERGENCY PERSONNEL, AND PEOPLE ON THE GROUND, AND EXERCISING REASONABLE JUDGMENT WHEN EVALUATING WHETHER IT IS SAFE TO OPERATE DJI PRODUCTS AND/OR SERVICES AT A GIVEN TIME OR PLACE.
DJI IS UNDER NO OBLIGATION TO RESTRICT YOU FROM FLYING YOUR DJI PRODUCTS AND/OR SERVICES IN AREAS THAT POSE SAFETY OR SECURITY CONCERNS. DJI RESERVES THE RIGHT TO LIMIT OR PROHIBIT THE OPERATION OF DJI PRODUCTS AND/OR SERVICES IN LOCATIONS THAT RAISE OR MAY RAISE SAFETY OR SECURITY CONCERNS. EVEN IF A LOCATION OR A FEATURE WAS PREVIOUSLY PERMITTED OR UNLOCKED, DJI RESERVES THE RIGHT TO ADJUST OR REVOKE THE UNLOCKED STATUS OF SUCH LOCATION OR FEATURE AT ANY TIME, WITH OR WITHOUT NOTICE, BASED ON SAFETY CONDITIONS OR OTHER CIRCUMSTANCES.
YOU UNDERSTAND AND AGREE THAT THE GEO-FENCING SYSTEM AND THE UNLOCK FEATURE MAY BE AFFECTED BY OBJECTIVE FACTORS SUCH AS NETWORK SIGNALS, GPS/SATELLITE POSITIONING ACCURACY, DELAYS IN MAP DATA UPDATES, AND THIRD-PARTY DATA SOURCES. DJI MAKES NO EXPRESS OR IMPLIED WARRANTY AS TO THE TIMELINESS, COMPLETENESS, OR ACCURACY OF THE INFORMATION REGARDING GEO-RESTRICTED ZONES.
YOU ASSUME ALL RISKS ARISING FROM YOUR USE OF DJI PRODUCTS AND/OR SERVICES (INCLUDING THIS UNLOCK FEATURE). YOU UNDERSTAND AND AGREE THAT YOU USE THIS UNLOCK FEATURE AT YOUR OWN DISCRETION AND RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU ARE SOLELY RESPONSIBLE FOR ANY PERSONAL INJURY, DEATH, LOSS OF DATA, OR DAMAGE TO YOUR OWN PROPERTY (INCLUDING YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR DJI PRODUCTS AND/OR SERVICES USED IN CONNECTION WITH THIS UNLOCK FEATURE) OR THIRD-PARTY PROPERTY RESULTING FROM YOUR USE OF OR INABILITY TO USE THIS UNLOCK FEATURE.
THE UNLOCK LICENSE YOU OBTAINED FOR DJI PRODUCTS AND/OR SERVICES IS FOR YOUR INDIVIDUAL USE ONLY UNDER SPECIFIC CONDITIONS. IF YOU TRANSFER, LEND, OR DELIVER THE DJI PRODUCTS AND/OR SERVICES TO ANY THIRD PARTY IN ANY MANNER (WHETHER WITH OR WITHOUT CONSIDERATION), YOU GUARANTEE TO REMOVE ALL UNLOCK LICENSES BOUND TO SUCH DJI PRODUCTS AND/OR SERVICES PRIOR TO DELIVERY. IF ANY THIRD PARTY CONTINUES TO OPERATE DJI PRODUCTS AND/OR SERVICES USING THE UNLOCK LICENSE YOU OBTAINED AND FAILED TO REMOVE, YOU SHALL BE SOLELY RESPONSIBLE FOR ANY DAMAGES AND LEGAL RESPONSIBILITIES SO CAUSED, AND DJI ASSUMES NO LIABILITY THEREFOR.
SOME JURISDICTIONS MAY PROHIBIT OR LIMIT DISCLAIMERS OF WARRANTIES, AND THEREFORE YOUR RIGHTS MAY VARY FROM JURISDICTION TO JURISDICTION.
