TERMS AND CONDITIONS FOR DJI UNLOCK FEATURE

Thank you for your interest in the DJI Unlock Feature provided by SZ DJI Technology Co., Ltd. and its affiliates (“DJI”, “we,” or “us”). By applying for the Unlock Feature, you acknowledge that you have read, understood, and agreed to be bound by the following terms and conditions, the DJI UAS Products Terms of Use,  the DJI Go 4 App Terms of Use,  the DJI Fly App Terms of Use,  the DJI Go App Terms of Use, the DJI Privacy Policy and the DJI Website Terms of Use (together, these “Terms”). If you are not eligible or do not agree to any of these Terms, then you may not apply or use the Unlock Feature.

Please read the information disclosed below carefully, as we have established specific information practices and disclaimers for the Unlock Feature that may differ from the rest of the Terms. In the event of any conflict between the terms and conditions below and any other agreements you have entered into with DJI regarding the issues stipulated herein, the following terms and conditions shall prevail.

About Unlock Feature

The Unlock Feature allows you to enable flight in a location that may be restricted due to a safety or security concern, such as near an airport, over a power plant or exceed the height limitation. Due to the heightened sensitivity of these restricted areas, we ask that you provide additional information about yourself, including documentation verifying your authorization to fly in the designated area (see “Information Practices” below for more information). In the event of a safety or security issue, we reserve the right to disclose any information you provide to us if required to do so by law or in a good-faith belief that such action is necessary to comply with applicable laws, in response to a court order, judicial or other government subpoena, warrant or request, or to otherwise cooperate with law enforcement or other governmental agencies.

To apply for the unlock feature, you will be required to provide us with some information about yourself and your intended flight location, including:

You represent and warrant that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times. You accept responsibility for all activities that occur under your DJI account or by your DJI hardware, including any activities that occur in unlocked zones or otherwise in connection with the Unlock Feature.

We use and disclose the information you provide to us in accordance with the DJI Privacy Policy.

Disclaimers

YOU ARE SOLELY RESPONSIBLE FOR THE SAFETY OF YOUR FLIGHT OPERATION, INCLUDING BUT NOT LIMITED TO OBTAINING ANY REQUIRED GOVERNMENTAL AUTHORIZATIONS AND MAINTAINING A SAFE DISTANCE FROM MANNED AND UNMANNED AIRCRAFT TRAFFIC, STRUCTURES, VEHICLES, GROUND HAZARDS, INFRASTRUCTURE, EMERGENCY PERSONNEL AND PEOPLE ON THE GROUND, AND EXERCISING REASONABLE JUDGMENT WHEN EVALUATING WHETHER OR NOT IT IS SAFE TO OPERATE DJI HARDWARE (AS DEFINED IN THE DJI GO/DJI GO 4 APP TERMS OF USE) AT A GIVEN TIME OR PLACE, NOTWITHSTANDING THE UNLOCKING OF ANY ZONES.

DJI IS UNDER NO OBLIGATION TO RESTRICT YOU FROM FLYING YOUR DJI HARDWARE IN AREAS THAT POSE SAFETY OR SECURITY CONCERNS. DJI RESERVES THE RIGHT TO LIMIT OR DISABLE THE OPERATION OF THE DJI HARDWARE IN LOCATIONS THAT RAISE SAFETY OR SECURITY CONCERNS AND THESE LOCATIONS MAY CHANGE WITH OR WITHOUT NOTICE WHEN DJI DETERMINES THAT A LOCATION RAISES A SAFETY OR SECURITY CONCERN, EVEN IF THE LOCATION WAS PREVIOUSLY PERMITTED OR UNLOCKED BY DJI.

YOU ASSUME ALL RISK FOR ANY DAMAGE THAT MAY RESULT FROM YOUR USE OF OR ACCESS TO ANY UNLOCKED ZONES OR THE DJI UNLOCK FEATURE. YOU UNDERSTAND AND AGREE THAT YOU USE THE SERVICE AT YOUR OWN DISCRETION AND RISK, AND THAT YOU ARE SOLELY RESPONSIBLE FOR ANY PERSONAL INJURY, DEATH, DAMAGE TO YOUR PROPERTY (INCLUDING YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR DJI HARDWARE USED IN CONNECTION WITH THE SERVICE) OR THIRD-PARTY PROPERTY, OR THE LOSS OF DATA THAT RESULTS FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

THE UNLOCK LICENSE YOU OBTAINED FOR DJI HARDWARE IS FOR YOUR OWN USE. IF YOU TRANSFER THE DJI HARDWARE TO A THIRD PARTY, YOU GUARANTEE TO REMOVE ALL UNLOCK LICENSE FROM DJI HARDWARE BEFORE MAKING SUCH TRANSFER (THE SPECIFIC REMOVAL METHOD IS AS PROVIDED BY THE APP AT THAT TIME). IF ANY THIRD PARTY CONTINUES TO OPERATE DJI HARDWARE BY USING THE UNLOCK LICENSE YOU OBTAINED, YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGES AND LEGAL RESPONSIBILITIES SO CAUSED.

SOME JURISDICTIONS MAY PROHIBIT A DISCLAIMER OF WARRANTIES, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.
